“San Francisco Residents Sue City Officials over Alleged Unconstitutional Transgender Support Program”

A group of San Francisco residents is taking legal action against city officials due to a program they claim to be illegal, which uses taxpayer finances to support black and Latino biological men who associate themselves as females. In November 2022, Democratic Mayor London Breed set in motion the “Guaranteed Income for Trans People (GIFT) Program”. This scheme aims at alleviating financial instability within trans communities by offering low-income transgender individuals in San Francisco $1200 each month for up to 18 months.

The case was instigated by Judicial Watch, a nonprofit legal organization. The entity argues that this program infringes on constitutional rights due to how it allegedly offers preferential treatment. The plaintiffs contest that the GIFT program’s utilization of taxpayer funds is unacceptable under Article 1, section 7 of the California Constitution. They insist that favoring biological males who identify as women is immediately suspect and cannot withstand stringent review.

Defendants named in the lawsuit include Mayor Breed, José Cisneros (the treasurer for the City and County of San Francisco), an anonymous individual serving as the director of the Office of Transgender Initiatives for the City and County of San Francisco, and Carmen Chu, who functions as city administrator.

When initially launched, the GIFT project welcomed applications from 55 individuals. It also presented access to essential healthcare services explicitly aligning with their gender identification needs. These initially distributed funds commenced in January 2023 and are anticipated to continue throughout 2024.

This beneficial program is even open to undocumented people should they meet other set criteria. As Mayor Breed passionately stated, this system is implemented as escapism from poverty and discrimination faced commonly within trans societies.

Concerns raised by the plaintiffs cite racial and sexual discrimination since only transgender minorities can apply for this aid. They appealed court intervention so as not to use taxpayers’ money in supporting such programs.

Judicial Watch’s President Tom Fitton insisted that transgender influentials are using taxpayers’ money unethically. He suggested that this act is in clear breach of the state’s constitution laws.
