Empower Oversight, a group committed to ensuring the transparent functioning of government authorities and corporations, has filed a lawsuit against the Department of Justice. The complaint accuses the DOJ of alleged covert surveillance activities directed at diverse members of congressional staff involved in scrutinizing the Department’s actions.

On Tuesday, Empower Oversight initiated legal proceedings in the U.S. District Court for the District of Columbia. The group’s aim is to demand adherence to public records access laws under the Freedom of Information Act.

According to the lawsuit, these records cast light on intricate web woven by DOJ since 2016. The goal– clandestine surveillance targeted at various congressional staff members from both major political parties dutifully conducting their constitutional mandate to oversee the department. This covert surveillance is now beyond dispute as several technology companies have confirmed receipt of subpoenas demanding communication records of respective staffers. Coupled with non-disclosure orders (NDOs), these companies were legally bound not to alert the personnel involved.

To lend credibility to its claims, Empower Oversight pointed towards an instance whereby its founder, Jason Foster was targeted through a subpoena served on Google in 2017 requesting information linked to an email address and two Google Voice phone numbers associated with Mr.Foster’s family phones and his official Senate line.

At that time, Jason Foster held the position of Chief Investigative Counsel to the U.S. Senate Judiciary Committee. His duties revolved around leading investigations into misconduct acts, wastage, fraud or abuse within DOJ’s operations. It was only until six years later in 2023 when Mr.Foster got notified about these subpoenas due to a série of non-disclosure orders enforced upon Google by DOJ.

The additional information provided indicated that Mr.Foster was not alone—several other accounts listed in the subpoena belonged to staffers across party lines working for House and Senate Committees also vested with oversight responsibilities over DOJ activities.

These controversial circumstances are central to pertinent power separation issues that were allegedly ignored by DOJ at the time when the subpoena was served on Google.
