The continuous decline of Joe Biden’s credibility in the polls, paired with his seeming reluctance to withdraw from the presidential race, has prompted increased consternation within the Democratic Party. John Banzhaf, a well-respected professor at George Washington University Law School, strongly promotes this “Plan C.” He argues that a Biden-Obama ticket would provide the party with a more formidable stand against Trump. Banzhaf contends that former President Obama is among the few individuals positioned to inject trust and appeal into an otherwise chaotic situation.

Despite raising eyebrows amongst skeptics who cite constitutional restrictions prevent Obama from returning as president, Banzhaf asserts there’d be no legal impediment for him becoming vice president. He explains that while the 22nd Amendment might seem to prohibit elected presidents from serving more than two terms or acting as president for over two years when someone else was elected president, it does not explicitly stop anyone from being elected vice president. Subsequently, this position would allow succession to presidency without another election.

Banzhaf elaborates: “According to the overly precise language deliberately carefully chosen by the drafters…there’s nothing [that] says he cannot be elected to the office of vice-president,” implying that through this role, Obama could become president once again should Biden be incapable or choose to abdicate his position.

Critics find such interpretation groundless and potentially dangerous. To them, it seems like an attempt by left-wing legal thinkers to manipulate constitutional provisions for political gain. Nevertheless, Professor Banzhaf believes that failure of ‘Plan B’, coupled with growing public unrest towards current administration’s policies makes his proposed ‘Plan C’ least objectionable of several unappealing choices.

As for Biden’s campaign, they would continue to benefit from funds already raised under the Biden-Harris banner since these cannot be simply transferred to an entirely new candidate.
